The man who raped two women in one of Skyline parking lots early last year has been convicted and sentenced.
In a trial on March 27, Timothy Paul Layton was found guilty and has been sentenced to 46 years in prison.
Layton’s defense has filed a notice of appeal on April 4.
On March 25, 2002, Layton drove a prostitute to parking lot two and raped her.
He repeated the same offence with a different prostitute on April 22, 2002. He was arrested by Brisbane Police later that month.
Layton initially denied the facts, claiming that he had never been with the victims. However, evidences surfaced pointing him as the perpetrator. He then admitted to having sex with one of the victims but maintained that it was mutually consented.
According to an employee of the San Mateo County Superior Court who wishes to remain anonymous, the notice of appeal has been received. The court is now preparing the necessary paperwork in order to send it to the Ninth Circuit Court of Appeals in San Francisco, who holds the final decision.
Layton is currently in Saint Quentin federal prison awaiting the outcome of the appeal.
